Every employee has the right to paid holiday - under European law, a minimum of four weeks (plus Bank Holidays) a year. That right accrues for every day you are at work - but what if you are off sick? The European Court of Justice has just ruled in a long-running dispute that the right is absolute and accrues in sickness and in health.

The House of Lords still has to rule on how this judgment will be applied in the UK, but employers will probably need to review their absence policies. Some long-term absentees may be able to claim back pay for holiday that they were unable to take.
